Jersey City Council to vote on $200k settlement for bicyclist hit by unmarked police car

The Jersey City Council will vote on a $200,000 settlement for a bicyclist hit by an unmarked police car while riding his bicycle on October 6th, 2021 at Wednesday’s meeting.

Chirag Khushalani filed a lawsuit against the City of Jersey City, Hudson County, the State of New Jersey, and Police Officer Charles Tavares after being hit by an unmarked police car about 14 months prior.

“Considering the risks and costs associated with trial that could result in a verdict in excess of the settlement amount, the Acting Corporation Counsel has recommended a settlement to pay the plaintiff the total sum of $200,000.00 because the risks and costs involved with conducting a trial include the possibility of a verdict that exceeds the settlement amount,” the resolution says.

As is typical for lawsuit settlements in New Jersey, the city does not admit to any wrongdoing and Khushalani cannot file any additional claims related to the incident.

He must be paid within 120 days of the settlement being approved and the check will be made out to “Davis, Saperstein and Salomon in trust for Chirag Khushalani.”

The matter only came up very briefly at today’s caucus meeting, which lasted just over an hour.

“We sent a confidential memo. You should have received it last week. Just let me know if you have any questions,” Acting Corporation Counsel Brittany Murray stated.

The Jersey City Council will convene for their regular meeting on Wednesday at City Hall, 280 Grove St., at 6 p.m. and the session will also stream live on Microsoft Teams.
