“The driver was issued summonses for speeding and failure to yield to a pedestrian. The victim remains in critical condition and no charges have been filed at this time,” Schillari said in a statement.

Sources, who spoke under the condition of anonymity since they were not authorized to speak on the matter, said that Melone Smith, 61, of Paterson, was driving 32 miles per hour in the 25 mile per hour zone, so the incident did not rise to the level of criminality.

Smith hit Yeoman Ann, 62, of North Bergen, with her car while she was crossing the street near the entrance of the Bruin Stadium parking lot, located in James J. Braddock Park, on the morning of October 2nd.

Authorities previously said that Smith is cooperating with the investigation.
