Amended wage suit claims ex-Bayonne worker ‘is mentally dysfunctional,’ epileptic

An amended lawsuit filed by a former employee of the Bayonne recreation department claims he “is mentally dysfunctional” and epileptic in a case where he is seeking roughly 32 years in backpay and damages that totals roughly $2 million.

“Plaintiff [Tyrone] Sims is a “special needs” adult, presently 56 years of age …  Mr. Sims since his early childhood, has suffered from a neurological deficit in his left hemisphere and is mentally dysfunctional; Mr. Sims has very low cognitive ability in terms of understanding events surrounding him,” the amended lawsuit, filed on December 30th, says.

“Mr. Sims is also an epileptic who, at least for the last 20 years, been subject to and plagued by seizures and has been prescribed and daily ingests anti-seizure medications including carbamazprine, keppra and phenytek; in combination these medications further diminish and burden Mr. Sims’ already reduced cognitive ability.”

Edison-based attorney Jarred S. Freeman, who is representing Sims in the matter, says that his client “remains unaware of the financial exploitation” committed to the city and it was his siblings who first discovered the alleged financial discrepancies.

Sims, through the suit, claims he had worked for the city from August 1st, 1990, hired at a wage of $3 per hour instead of the state mandated minimum wage of $3.50 per hour,  through December 31st, 2018.

Another notable change from the original complaint, which was filed in August, as HCV first reported, is no longer asking for $1 million in compensatory damages.

The alleged compensatory damages is instead pegged at $319,157.28 for back pay and $638,314.56 for exemplary damages for a total of $957,471.84, as well as $1 million in punitive damages (which could be a greater number determined at a jury trial).

Hudson County Superior Court Judge Peter Baker approved a motion to amend the case, which the city opposed, on December 18th.

A city spokesman said it is their policy not to comment on pending litigation.

  1. First of all, why is his medical record been publicized???
    2nd it does not matter whom discover the exploitation.
    3rd that attorney should be fired.
    4th look like someone is looking for a quick settlement and is not willing to defend the victim.

    So sad, and embarrassing that slavery still existed in America.
