WNY, NB resident files suit against Count Wiley and wife alleging voter fraud

A West New York and North Bergen resident have filed a joint Hudson County Superior Court civil lawsuit against West New York Commissioner Count Wiley, his wife Beatriz and the boards of education in both municipalities, alleging that one, or both, of the Wileys have committed voter fraud in recent years.

The suit, filed on April 2, has West New York resident Ernesto Vasquez, and North Bergen resident Gina Miranda-Diaz, suing Count and Beatriz Wiley – as well as the boards of education in West New York and North Bergen.

They are represented by the Newark law firm McElroy, Deutsch, Mulvaney and Carpenter.

Vasquez, a 22-year-old employee at the Weehawken Pathmark, and Diaz, a West New York Town Hall employee who spoke in support U.S. Sen. Bob Menendez (D-NJ) the day he was indicted on corruption charges, contend in the lawsuit that either Count or Beatriz Wiley committed voter fraud since they hold elected office in the neighboring North Hudson municipalities.

As Hudson County View reported, Frank Ferreiro, an adamant supporter of Mayor Felix Roque, has been pushing the same argument in recent weeks.

The complaint looks at the recent voting records of Beatriz Wiley, as well as the fact that the couple has a child enrolled in both the West New York and North Bergen school systems (which require proofs of residency), as reasons why voter fraud has been committed.

Pastor Ralph Sanchez, Jr., the campaign spokesman for Count Wiley’s West New York United team, said in an email that “this lawsuit is a politically motivated, frivolous lawsuit that is wasting the taxpayer’s dollars.”

Pablo Fonseca, Roque’s campaign spokesman, of course took a different tone on the matter.

“It would be an injustice for the residents of West New York for Count Wiley to be on the ballot and not live in West New York. In reading the complaint, there are enough outstanding issues that are questionable to know if he really does live in West New York. The residents of West New York deserve better.”

“The residents of West New York have zero tolerance for fraud and corruption in this upcoming election and they deserve to vote for people that live in the town of West New York.”

At a press conference on April 1, Wiley responded to Ferreiro’s continued voter fraud allegations in an interview with Hudson County View.
